eValuShop's Business Policies

eValuShop Inc is committed to provide top quality merchandise and premier services for our discerning customers.   The following policies apply to all transactions carried out between eValuShop, Inc and you, herein referred to as the customer.   Transactions conducted between independent sellers and buyers at Flea Mart's peer-to-peer online auctions are covered by their respective Terms of Use.
Changes and Updates
eValuShop reserves the rights to update, enforce and change the policies as and when the needs arise.   By shopping at eValuShop.com, the customer agrees that eValuShop may revise these policies and change the services provided at any time.   Such revisions or changes shall be binding and effective immediately on posting of the changes on this Web page or on notification to all existing customers by e-mails.   The customer agrees to review these policies periodically to be aware of any such revisions.
Shipping Policy: We do not ship overseas
With eValuShop's low-price, low-margin strategy, it may not be possible to offer free shipping on all products because the shipping charges may wipe out the entire profit margins or in some cases, exceed the selling prices of low-value merchandise.   Nevertheless, eValuShop understands what the consumers want and will do its best to offer free shipping whenever it is possible.

To minimize the shipping and handling charges, eValuShop has made arrangements with our suppliers to ship products directly to our customers.   While this arrangement helps to trim our ooperating costs and avoid making double trips to ship products from suppliers to fulfillment center before shipping to customers, customers may receive their orders in multiple shipments.   We seek customers' understanding for the inconvenience caused.

To streamline our operations further, eValuShop has decided not to ship orders outside the United States for the time being.   This policy helps us achieve economies of scale in operations and optimize our order fulfillment process. Besides, the high costs of shipping an order from the U.S. to foreign countries can be a big deterrent to potential shoppers.   eValuShop believes the only practical way to fulfill overseas orders cost-effectively is to set up overseas warehousing and order fulfillment facilities in the future.
E-Payment Processing by PAYPAL
In online payment processing, there is no foolproof way to verify whether the customer is the rightful owner of the credit card account being used to effect the payment.   Any person who possesses a legitimate owner's credit card numbers can use them to make purchases online.   Consequently, it is not surprising that credit card frauds can easily exceed 10 percent of total sales turnover for online retailers as opposed to less than one percent recorded at traditional brick-and-mortar retailers.

eValuShop processes all e-payments by PayPal.   Customers can pay with either credit cards or funds in their PayPal accounts.  The billing address associated with your credit or debit card can be verified somewhat by the Address Verification System (AVS).   However, AVS service is not available to cards issued by non-US banks.   Hence, we encourage all customers, particularly those holding cards issued by non-US banks, to open verified accounts with PayPal.   This payment option is relatively safe because PayPal verifies a customer's identity by charging a token fee to the credit card or bank account linked to his PayPal account.   Whenever necessary, eValuShop may require customers to provide documentary proof of identities, particularly for high-ticket purchases.
Security and Customer Privacy
The customer's personal particulars are safe with us.   eValuShop provides SSL-encrypted secure environment for accessing accounts and processing orders.   With Secure Socket Layer (SSL) implemented on both the client and server, information sent via the Internet can be trusted to arrive safely to our server.   eValuShop does not have access to customers' credit card numbers.   All online payments are processed by PayPal, one of the leaders in online payment processing.

eValuShop is committed to protect the customers' privacy.   Personal information collected on the user's registration form and order form is meant for completion of online orders.   eValuShop does not sell, rent or share this information with outside parties, except with third party logistics and payment service providers deemed necessary to complete a transaction.
Order Fulfillment
An email transmitted automatically to acknowledge the receipt of an order does not constitute a sale agreement.   All orders received essentially go through the following states: New, Paid, Hold, Pending, Shipped and Completed.   A transaction occurs only when eValuShop accepts customer's order with an email confirmation and updates the order's status to "Shipped" accordingly.

The order fulfillment process is transparent to the customers.   The status of an order is reflected instantaneously in the customer's purchase records, which is accessible from his online user account.   Customers who wish to change items in their orders should contact us before the orders proceeded to "Shipped" state.   During the "Pending" state, all orders will be checked for stock availability.   For those items that are out of stock, customers can either accept the back orders for items to be delivered at a later date or seek a partial or full refund.   All refunds will be made through PayPal.

Customer must provide a correct shipping address and ensure that someone is there to receive the goods.   Customer shall bear the additional expenses (including shipping and handling fees) incurred in making a repeat delivery.   Customer shall be deemed to have accepted products in good condition unless eValuShop is notified otherwise within 24 hours after the delivery.

Force Majeure.   eValuShop normally takes less than seven days to fulfill an order subject to stock availability.   However, delivery schedule shall be used as an indication only and eValuShop does not bear any responsibility for late delivery.   eValuShop shall not be liable for any delay in performing any of our obligations under the agreement if such delay is caused by circumstances beyond our reasonable control.   eValuShop shall be entitled to a reasonable extension of time for the performance of such affected obligations.
Order Cancellation
eValuShop reserves the rights at its sole discretion to cancel an order suspected to be a potential fraud.   Fraud suspect will be blacklisted and a warning about this status will be displayed on all your orders.   Submitting fake personal information can also be grounds for suspension or termination of the customer's account.

Customers can also exercise their rights to cancel an order.   eValuShop will issue a full refund if order is cancelled before it is "shipped".   A cancellation charge or restocking fee may be payable once the order is reflected in "Shipped" state, which means that order has been packed and handed over to the logistics partner for shipping to the recipient's premises.   All refunds will be effected through PayPal.
Satisfaction Guarantee and Return Policy
eValuShop guarantees that all items sold are of good merchantable quality.   eValuShop has worked with our suppliers to provide one-to-one exchange if any item is of sub-standard quality.   In the case where an item is no longer available, eValuShop will replace it with a similar product of equal or higher value.   This guarantee is offered in good faith and does not constitute an acceptance of unlimited warranties.

Customers may return the products in their original packaging within a reasonable period of time if they are not satisfied with their purchases.   The terms and conditions differ with each supplier, although most suppliers charge a restocking fee and require the customers to bear the expenses incurred to ship the returned goods to their premises. Limited Liability and Indemnification
The customer agrees that eValuShop shall not be hold liable for any of the following circumstances:

Losses or liabilities resulting from the use of defective merchandise or misuse of product purchased from eValuShop as well as from acts or events beyond our control.   eValuShop will not be liable for any indirect, special, incidental or consequential damages of any kind regardless of the form of action whether in contract, tort, negligence, or otherwise, even if eValuShop has been advised of the possibility of such damages.

All claims for damages should be directed to the respective manufacturers or suppliers as stipulated under the rights protected by the manufacturer's warranties for the defective merchandise.   The customer agrees to indemnify and defends eValuShop and its officers, directors, employees and agents from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any claim for damages.

In no event shall eValuShop's maximum aggregate liability exceed the total amount paid by the customer for the disputed merchandise, but in no event greater than one hundred dollars ($100.00).   In the case where exclusion or limitation of liability for consequential or incidental damages is not allowed, eValuShop's liability shall be limited to the maximum extent permitted by the laws.
